Terms of Service

ClusterFast is provided by TOV "KRYSTAL IF" (Ukrainian legal name: TOVARYSTVO Z OBMEZHENOIU VIDPOVIDALNISTIU "KRYSTAL IF"), company code 33450951, registered address: Ukraine, 01054, Kyiv, Yaroslaviv Val Street, building 17A, office 100A.

ClusterFast is a SaaS platform for market research, audience intelligence, ICP validation, segmentation, personas, campaign planning, research question generation, and related AI-assisted workflows.

AI-generated outputs are drafts and recommendations. You are responsible for reviewing, validating, and approving any output before using it in business, marketing, legal, financial, or advertising decisions.

You must provide accurate account information and keep access credentials secure. You are responsible for activity performed through your account.

You may register or log in with email/password or Google authentication where enabled. Administrator accounts may require additional two-factor authentication.

If you forget your password, you can set a new one through the reset link sent to your email address. Resetting a password ends all active sessions.

You retain ownership of briefs, project data, uploaded materials, manual performance notes, generated outputs, and other content you provide or create in ClusterFast.

You grant ClusterFast the limited right to process customer data as needed to provide, secure, maintain, improve, and bill for the service, including by sending relevant prompts and context to configured AI providers.

Do not submit sensitive personal data, special category data, secrets, credentials, payment card data, or data you are not authorized to process.

ClusterFast may use third-party AI and infrastructure providers, including OpenAI-compatible services, hosting providers, Google authentication, and Meta integrations if you connect them.

If you connect a third-party service, you confirm that you have the right to connect that account and allow ClusterFast to process the required tokens, identifiers, and account metadata for the requested integration.

AI features consume CF Tokens. Tokens are a product usage unit and are not money, electronic money, securities, or a stored-value payment instrument. They cannot be exchanged for cash or transferred between accounts.

Card payments are processed by WayForPay. ClusterFast never receives or stores full card details; the provider handles them under its own terms and security standards.

All prices are shown in US dollars and include the token amount granted. A plan is a subscription and can be billed monthly or, at a discount, every 3, 6, or 12 months; the chosen billing period is described in section 7. Top-ups are separate one-off payments that add tokens to the balance without creating or changing a subscription.

Tokens granted by a plan carry the expiry and rollover shown for that plan at the time of purchase. Prices, package contents, and token costs per action may change; changes apply to future purchases and to renewals after notice under section 7.

Refunds are handled under section 7 and applicable consumer law. Statutory rights that cannot be waived are unaffected by these Terms.

Every plan is a subscription. When you buy one you explicitly consent, by ticking the confirmation box at checkout, to your card being stored by the payment provider and charged automatically.

You choose the billing period when you subscribe: monthly, or every 3, 6, or 12 months at a discount. The price shown at checkout covers the whole period and is charged once per period, on the anniversary of the first payment, until you cancel. Each successful charge grants that period's token allowance. The amount does not change on its own: moving to a different plan or a different billing period is a new purchase, and buying extra tokens is a separate one-off payment you initiate yourself.

You can cancel at any time on the Billing page or from Account settings, with no explanation required and no cancellation fee. Cancelling stops all future charges. It does not refund the current period: the plan stays active until the end of the period you already paid for, and tokens already granted remain on your balance and keep their expiry.

If a charge fails, the provider may retry it. If it still fails, the subscription is suspended and AI features stop when the balance runs out. You can resume by paying again.

If the price of a plan changes, existing subscribers are notified by email at least 14 days before the change takes effect, and may cancel before the next charge.

Top-ups are not subscriptions. They are a single payment that adds tokens to your balance, and nothing is charged afterwards.

ClusterFast may transform customer inputs and outcomes into pseudonymized tags, signals, and aggregated patterns to improve recommendations across similar use cases.

The Learning Core is designed to avoid storing raw personal data in shared patterns. Service-level learning through anonymized tag aggregation is part of the product. Source records linked to a user or project remain subject to the Privacy Policy and retention controls while aggregated anonymous patterns may be retained when they are no longer reasonably re-identifiable.

You may not use ClusterFast to violate law, infringe rights, generate deceptive or harmful content, attempt unauthorized access, overload the service, bypass billing controls, or reverse engineer protected parts of the platform.

We may suspend access if usage creates legal, security, abuse, or payment risk.

The service may change as the product evolves. We may add, remove, or modify features, providers, packages, limits, and integrations.

We aim to keep the service available, but do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, ClusterFast is provided on an "as is" and "as available" basis. We are not liable for indirect, incidental, special, consequential, or lost-profit damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

You may stop using the service at any time. We may suspend or terminate accounts for material breach, unlawful use, security risk, or non-payment.

After termination, data may be retained or deleted according to the Privacy Policy, legal requirements, backups, and technical retention schedules.

Where applicable law, including the GDPR, gives you the right to erasure, you may request deletion of personal data and customer-linked workspace data processed by ClusterFast.

Self-service account deletion. Logged-in users can delete their account from Account settings → Delete account. This starts immediate account erasure: all workspace projects and their briefs, generated outputs, and related metadata are deleted; project-linked integrations such as Meta are removed with the project; learning source records, market signals, prompt-learning usage, and related learning metadata for your projects are deleted or irreversibly anonymized: records covered by your cross-customer learning consent are retained in anonymized form (re-keyed at deletion so they can no longer be linked to you, your account, or your projects), while records without such consent are deleted; tool feedback and learning consent records are deleted; authentication credentials, Google sign-in linkage, administrator 2FA secrets, and active sessions are cleared; and your account identifier is anonymized. Your CF Token wallet balance is zeroed.

Project-only deletion. You may delete an individual project from the workspace. Project deletion removes that project, its briefs and generated outputs, connected Meta integrations for that project, and learning source records tied to that project (deleted where no cross-customer learning consent was given, otherwise retained in irreversibly anonymized form).

What may be retained. We may retain minimized billing, payment, token ledger, OpenAI usage, subscription, purchase-request, and privacy audit records with anonymized references where needed for legal obligations, accounting, fraud prevention, dispute handling, and security. Irreversibly anonymized Learning Core tag aggregates that are no longer reasonably linkable to you, your account, or your business may also remain, as described in these Terms and the Privacy Policy.

Backups and logs. Deleted data may persist for a limited period in encrypted backups, server logs, and security audit trails before routine rotation removes it.

When you cannot use self-service. If you cannot access your account, contact support@clusterfast.app from the email address associated with your account. We may need to verify your identity before processing the request. Where GDPR applies, we respond within one month of a valid request unless an extension is permitted by law.

Administrator accounts. Administrator accounts cannot be self-deleted through the product workflow. Contact support@clusterfast.app for assistance.

Other privacy rights. For access, correction, restriction, portability, objection, and related rights, see the Privacy Policy at /privacy.

We may update these Terms. Continued use of ClusterFast after an update means acceptance of the updated Terms, where permitted by law. Material changes may require renewed acceptance.
